Mr. Schooler has practiced law for forty years, following his completion of a clerkship with the Honorable United States District Judge Carl O. Bue, Jr. of the United States District Court for the Southern District of Texas (Retired).  His practice primarily focuses on management-side labor and employment law, which includes claims under all employment discrimination laws, wage and hour issues (such as exemptions and overtime) under the Fair Labor Standards Act, investigations by the Equal Employment Opportunity Commission, the Texas Workforce Commission and the Occupational Safety and Health Administration, ERISA litigation, litigation involving protection or exploitation of trade secrets and confidential information and intellectual property, and enforcing or challenging covenants not to compete.  Mr. Schooler also focuses his practice upon federal arbitrations and business litigation, federal appellate practice, bankruptcy and complex commercial litigation, construction litigation and arbitration, banking litigation, and real estate and title insurance litigation. Mr. Schooler's practice has previously included tax litigation, antitrust litigation, securities litigation, energy litigation, oilfield property litigation, and False Claims Act litigation.

Mr. Schooler has extensive experience in arbitration as an arbitrator on the Commercial and Employment Panels of the American Arbitration Association, and as an advocate. He has tried over 50 jury and non-jury cases, and he has argued numerous appeals in the United States Court of Appeals for the Fifth Circuit and in the Texas Courts of Appeals.  Mr. Schooler has frequently spoken on arbitration-related topics, including:

Annual Arbitration Update (Jan. 2016) presented at the State Bar of Texas Alternative Dispute Resolution Section’s all-day seminar;

Ethics for Arbitrators (Feb. 2016) presented to the Houston Bar Association Alternative Dispute Resolution Section; and

Latest Developments in Construction Law Arbitration (Apr. 2015) presented to the Houston Bar Association’s Construction Law Section. 

He has also written extensively on arbitration topics, including most recently:

Memberships & Affiliations

Mr. Schooler has since 1992 served as a panelist on the American Arbitration Association Panel of Arbitrators for Commercial and Employment Cases, and has completed training for service on the American Arbitration Association's Panel of Arbitrators for International Arbitration. He has been certified as a Fellow of the Chartered Institute of Arbitrators, and is a member of the Advisory Board of the Institute for Transnational Arbitration.  He currently serves as Chair of the State Bar of Texas' Alternative Dispute Resolution Section, and as Chair-Elect of the Houston Bar Association's Alternative Dispute Resolution Section.  Mr. Schooler also currently serves as Chair of the Houston Bar Association’s Labor and Employment Section.  He has previously served as Chair of the Houston Bar Association’s Federal Practice Section, and as a Council Member of the Houston Bar Association's Section of Litigation and Construction Law Section.  In addition, Mr. Schooler is a past Editor-in-Chief of the Houston Bar Association bi-monthly journal, The Houston Lawyer, and currently serves on the Board of Editors of the State Bar of Texas Appellate Section’s publication, The Appellate Advocate.
