BIOGRAPHICAL:

Gary L. Birnbaum is a Senior Litigation Member in the 57-attorney Phoenix, Arizona office of Dickinson Wright, PLLC. Mr. Birnbaum has significant experience in all aspects of commercial and real estate litigation and ADR. He has also handled business, real estate and securities transactions in various contexts.

Mr. Birnbaum is a well-known lecturer on ADR and business and real estate valuation topics and has been a contributing author of the Commercial Real Estate Transactions Practice Manual, published by the State Bar of Arizona, Nichols on Eminent Domain, published by Matthew Bender, and The Law of Eminent Domain:  50 State Survey published by the American Bar Association. He has served as Chairman of the Law Practice Management Section of the State Bar of Arizona and is a member of the National Panel of Arbitrators and the Mediation Panel of the American Arbitration Association (AAA) and The Counselors of Real Estate. Mr. Birnbaum is also a Fellow of the American College of Trial Lawyers; Litigation Counsel of America; and the College of Law Practice Management. For many years he has been listed in The Best Lawyers in America® (Business Litigation, Real Estate Litigation, Real Estate, Condemnation Law, Legal Malpractice Defense, Bet-the-Company Litigation, Arbitration and Mediation).  He has served as Associate Dean for Program Development at the Sandra Day O'Connor College of Law at Arizona State University where he founded the Advocacy Program and still teaches advanced courses on "Private Property Rights" and "The Valuation of Real Estate and Closely-Held Businesses" as a member of the adjunct facility.  Mr. Birnbaum also served as a faculty member in Arizona State University's transdisciplinary Master of Real Estate Development (MRED) program and was a co-founder of that program.

In 2009, The Best Lawyers in America® selected Mr. Birnbaum as the "Bet-the-Company" Litigator of the Year for Phoenix, Arizona. In 2010, the same publication selected Mr. Birnbaum as the "Alternative Dispute Resolution" Lawyer of the Year for Phoenix, Arizona.  In 2012, he was selected as the “Eminent Domain and Condemnation Law” Lawyer of the Year; in 2013 he was recognized in the “Legal Malpractice-Defense” Lawyer of the Year; and most recently he was recognized as the 2014 “Arbitration” Lawyer of the Year.  Southwest Super Lawyers has designated Mr. Birnbaum as one of the "Top 50" attorneys in Arizona. He estimates that his mediation (and arbitration) experience has included at least 500 proceedings.

 

 

EDUCATION:

Mr. Birnbaum graduated summa cum laude (B.A. with highest honors) from the State University of New York at Binghamton and obtained his law degree (magna cum laude) from Indiana University where he served as Articles Editor of the Indiana Law Journal. Mr. Birnbaum has been elected to membership in Phi Beta Kappa and Order of the Coif.
